These Terms & Conditions govern your use of MagicTrip's website and services. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account, accessing, or using MagicTrip ("the Service"), you agree to these Terms. If you do not agree, do not use the Service. We reserve the right to update these terms with 30 days notice for material changes.

2. Description of Service

MagicTrip provides AI-powered travel planning and itinerary generation for China travel. The Service includes: AI-generated itineraries, destination guides, cost estimates, and optional human expert refinement. Itineraries are suggestions only and should be verified independently.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years old to use the Service. Notify us immediately of any unauthorized account use.

4. User Responsibilities

You agree to use the Service only for lawful purposes. You may not:

• Use the Service for any illegal activity or fraud
• Attempt to disrupt, overwhelm, or compromise our systems
• Scrape, copy, or reproduce our content without permission
• Provide false or misleading information
• Use the Service to generate harmful or offensive content

5. Intellectual Property

All content on the Service, including text, graphics, logos, and software, is owned by MagicTrip or its licensors. Generated itineraries are provided for personal use. You may not reproduce, distribute, or create derivative works without our written consent.

6. AI-Generated Content Disclaimer

Our itineraries and recommendations are generated by artificial intelligence and reviewed by human experts. While we strive for accuracy, we make no guarantees regarding:

• Accuracy of pricing, hours, or availability information
• Quality of recommended establishments
• Suitability of suggestions for your specific needs
• Completeness or timeliness of information

Users should independently verify critical information such as operating hours, prices, and booking requirements before travel.

7. Limitation of Liability

MagicTrip provides planning assistance only and is not a travel agency. We are not liable for:

• Losses or damages arising from use of generated itineraries
• Issues with third-party services (hotels, transport, tours)
• Travel disruptions, cancellations, or personal injury
• Indirect or consequential damages

Our total liability is limited to the amount paid for the Service in the preceding 12 months.

8. Payment & Subscriptions

Premium features require payment. Subscriptions auto-renew unless cancelled. Refunds are handled on a case-by-case basis. Prices may change with 30 days notice. All prices are in USD unless stated otherwise.

9. Termination

We may suspend or terminate your account for violation of these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These terms are governed by the laws of Colombia. Any disputes shall be resolved through binding arbitration in Bogota, Colombia. Users may also seek redress through applicable consumer protection laws in their jurisdiction.
